Cops: Man Caught Drinking With a Child in the Car

Arrests by Westhampton Beach cops through April 25.

A 37-year-old Shirley man was slapped with a felony charge under Leandra's Law on April 19 at 10:00 a.m. after Westhampton Beach Police found him passed out drunk in the parking lot of St. Mark's Church with his two-year-old in the car.

Police said that James J. Brennan, of Shirley, told them that he was waiting for his wife to pick him and his child up and that his child attends the St. Mark's nursery school.

Police said Brennan failed field sobriety tests and was charged with aggravated driving while intoxicated with a child 15 years or less, a felony under Leandra's Law. He was further charged with endangering the welfare of a child, a misdemeanor. His car was also seized.

Police said Brennan was held for arraignment and released by a judge.

DWAI

Also this week, police charged a 21-year-old Southold man* with driving while ability impaired, a violation. Police said they stopped the man on Dune Road at 4:52 a.m. on April 25 for speeding. His passenger was also issued a ticket for having an open container of Budweiser in the car.
