UPDATED: Oral Arguments Set in Eruv Battle

East End Eruv Association and local municipalities scheduled to head to court on June 14.

and the villages of Quogue, Westhampton Beach and the town of Southampton are scheduled to appear on June 14 before Judge Leonard Wexler and Magistrate E. Thomas Boyle in the U.S. Eastern District Court for oral arguments involving a lawsuit filed by the association in January.

In the suit, the East End Eruv Association claims their constitutional and civil rights have been violated in their effort to create a symbolic eruv boundary on telephone polls that stand within the municipalities.

The filed suit shortly after, asking the court for “clarification” on the issue.

The East End Eruv Association says the eruv, which would allow Orthodox Jews to push strollers and engage in tasks otherwise not allowed on the Sabbath, became a point of contention after the villages and the town sent letters to LIPA and Verizon saying an eruv cannot be placed on utility poles because the poles are within their right of way.

The municipalities further stated that if the East End Eruv Association wants to install lichis, which would mark the boundary as a string along the utility poles, they would need to apply for a permit.

The eruv association, however, claims a permit is not necessary since LIPA and Verizon own the poles and companies have already approved the placement of lichis on the poles.
