Bishop: I Should Get Paid Because The Constitution Says So

Do you think elected officials should still get paid during shutdown?

As hundreds of federal employees are furloughed as part of a government shut-down, the 535 members of Congress are continuing to collect pay checks — Among them Congressman Tim Bishop.

"The constitution prohibits any change of members of congress pay during their term — it requires that they get paid," Bishop told Patch on Tuesday morning as numerous Long Island Federal employees were receiving calls that they won't be getting a paycheck.

Bishop pointed to the 27th amendment, which was adopted in 1992, reading the words, "No law, varying the compensation for the services of the senators and representatives, shall take effect, until an election of Representatives shall have intervened."

In addition, Bishop said, "The president declared that Congress members are central employees."

That doesn't mean Bishop is not empathetic to those who are being furloughed.

"I think everyone should get paid to do the job that they were hired to do," he said. "This is an avoidable crisis."

Bishop, a Democrat, pointed to Republicans, stating that they are using extortionist tactics to get what they want.

"We have already compromised with the Republicans, accepting the number they want — $986 billion. But because they said no, cuts will continue making it difficult for Federal agencies to do their job and serve the people."

But while the Constitution states Congressman should get paid, many locals feels otherwise.

On Patch's Suffolk County Facebook pages, residents wrote the following statements:
  • "If the gov't shuts down they should be the first ones furloughed. It was their fault."
  • "Why should they get paid? Are they really that important?"
  • "Wrong .. Wrong ... Wrong! They should be ashamed of themselves!"
  • "It's disgusting."
  • "Our congress is NOT necessary, they are useless."
  • "This shutdown is tantamount to walking off the job. It is a disgrace and so are all politicians. Not much to say beyond this."
Now it's your turn: What do you think? Should Congressman Still Get Paid During the shut-down? Comment below.

quit whining about it and don't vote them back in
Sarah Thompson October 02, 2013 at 07:46 AM
Selfish. Congress is just plain selfish and greedy. They are supposed to be working for us. Ironic that some of the people that are paying their salary aren't getting paid. I think when this is over, they should get paid for a regular work week.

NO. SINCE OTHER AMERICANS ARE FEELING FALLOUT FROM THIS ACTION, SO SHOULD THOSE WHO CREATED THE BOMB. THIS IS A BLESSING IN DISGUISE. THOSE WHO WERE SLEEPING AND NOT PAYING ATTENTION WHAT OUR REPS ARE DOING IN WASHINGTON ARE NOW AWAKE. HHS "MANDATE" SHOULD HAVE NEVER PASSED IN TO LAW, AND SHOULD BE ABROGATED. FORCING AMERICANS TO PURCHASE ANYTHING BY LAW IS JUST PLAIN UNCONSTITUTIONAL. IT SOUNDS MORE LIKE COMMUNISIM TO ME. ANSWER? I, AS AN INDIVIDUAL AMERICAN, SHOULD BE ABLE TO PURCHASE A HEALTH CARE PLAN FROM ONE OF THE COMPANIES THAT PROVIDE IT, AND NOT HAVE TO BE "FULL TIME" OR BE ON A "GROUP PLAN". THEY DO IT FOR CAR INSURANCE, WHY NOT HEALTH? I WANT ALL OF THOSE IN CONGRESS TO LIVE ONE YEAR ON $20,000. (SINGLE) WITHOUT BACKUP I/E SAVINGS OR INVESTMENTS. WALK IN OUR SHOES.

Allen Schneider October 02, 2013 at 08:56 AM
Absolutely Not! If the Politicians can't complete the Peoples Business then they shouldn't get Paid! And if they think that Obamacare (ACA) Is so Great they should be required to be the first ones to sign up for it and make their families live with it!
jack Everett October 02, 2013 at 08:56 AM
"I think everyone should get paid to do the job that they were hired to do," he said." "This is an avoidable crisis." If this is the case why are they denying federal workers pay but insist they keep working? Does anyone really thing if these cons were going to lose one thin dime of their pay they would have pulled this blackmail? One of my democrat senators, Blumenthal decided to give his pay check to charitable causes as long as the government remains shutdown.
Ken Hermann October 02, 2013 at 09:27 AM
Disgraceful! Congress is simply disgraceful - they are self serving arrogant over-paid - naturally they would have a law so they get paid - who voted for that - certainly not me. Also they have exempted themselves from Obama-care; and on and on it goes. Disgraceful - all should be voted out. Every stinking one of them!
Hbjoker October 02, 2013 at 09:35 AM
Wow, that is some set of BALLS Tim. You have lost my vote and I hope & pray that anyone else who is sickened by his and other members of congress with their over the top pay and benefits votes for the other person in the upcoming election.
George Dubiel October 02, 2013 at 09:45 AM
yes congress decide to amend the constitution so that no matter what they get paid that didn't happen until there was a chance the government was looking at shutdowns.
David Martin October 02, 2013 at 09:58 AM
Hell no, They deserve to be FIRED for the sorry job they are doing. They want to push some junk Obamacare on us, something none of us need. If 30 million Americans are without health care, cover them, leave the rest of us alone.Start doing your jobs, stop treating your selves like you are some kind of Gods, Do what WE want you to do ,not whatever you want to do .You suck and so do your cronnies.
Peg October 02, 2013 at 10:21 AM
Our do-little Congressmen and Senators deserve to be paraded, single file to the Washington Monument and each padlocked into stocks for 8 hours each day they continue their infantile pissing match. I have plenty of tomatoes left in my garden that I'd be happy to share with my fellow Americans.
Mary Ann Rand October 02, 2013 at 10:39 AM
Congress should be impeached.
I Schnipper October 02, 2013 at 10:42 AM
1992? That's pretty recent. The 27th amendment should be repealed. So should the law that says Congress is able to give themselves raises that puts their salaries way above that of the average person. Congress is supposed to act for the people, by the people. I don't know anyone who was in favor of a government shutdown. Their over the top salaries and perks are paid for by out tax dollars. The Constitution never meant for Congress to be long term employment for a core group of people. The Founding Fathers saw first hand the results of what that means for a Country. Congresses men and women are only concerned about pleasing the people who can get them re-elected and not the country as a whole. It's said that money is the root of all evil. It's not the money. It's the power. And Congress is high off of that feeling that power brings. A testosterone laden pissing contest.
Robert Johnson October 02, 2013 at 11:13 AM
For everyday the House of Lords aka Congress shuts the United States of America down, they should lose one month's pay
Pauline Sasser October 02, 2013 at 11:20 AM
NO PAY FOR THEM.
Conservative Underground October 02, 2013 at 11:40 AM
This a complete joke; both parties in Congress have failed us, the American people and there is no way any of them, Mr. Bishop included, should receive one dime while government is shutdown. You should also ask with all their free time has Bishop's staff started signing up for Obamacare and has the Congressman himself signed up yet? He voted for it, he should sign up for it; lead by example.
Pete October 02, 2013 at 11:43 AM
NAH !
New Guy October 02, 2013 at 11:56 AM
This is easily fixable: 1) Term Limits 2) Each person working for the Government should be paying 100% of there medical and funding there own retirements. All of these bastards have some nerve collecting a paycheck, how dare they. If the media/politicians refers to us as the American people who are they?
judith chomiuk October 02, 2013 at 12:19 PM
judie no I do not think congress should get paid, bishop states the constitution says he is to get paid, but the congressmen put the admendment in there not the voting public. I also think the congressmen and senators should have to have the same pensions, health care and have to work the same amount of days that we have to. ENOUGH of this elitest membership.
Dino Diza October 02, 2013 at 12:47 PM
Hey! Bishop if you think that YOU should get paid. Then get off your Lazy Punk-Ass and get to work. YOU SHOULD NOT GET ANY PAY FOR DOING NOTHING. YOU ASS WIPES DON'T DO MUCH ANYWAY. I am SFC B F Diza in Los Lunas,NM Retired
elizabeth shelton October 02, 2013 at 12:59 PM
He should be thrown in a Federal prison for sedition, insurrection, treason, and failure to fulfill the obligation of office. That is in the Constitution as well. That out taxes pay is salary is criminal.
Mary Ann DiDonato Carmichael October 02, 2013 at 01:36 PM
When you hear them talking about how they are serving the people of this great nation, please read between the lines: " I've got mine and screw you". Don't forget, you keep electing these stand-up guys and now all you do is cry. Remember in November
DON BROOMALL October 02, 2013 at 01:40 PM
No pay, they violated the constitution. they should pay for their actions ,violated their Oath, to 'SERVE AND PROTECT"
Dalend October 02, 2013 at 01:51 PM
Impeach all of you reduce loud childish pomposity filled children of the congress who voted to not make agreements and any who did nor work seriously to compromise . Really how stipid are you , to ask the question shows how outside of reality you are . We here in the minimum range of survival states of America cry -uck you mother -uckers grow some balls get out here with us and change what can get things changes that can be changed. 1 spend money for aw ahold that will save us billions trillions easily in the next 10 years grow a field or two of solar generators on dessert land rich with sun energy spend and employ 3 trillion dollars to create these two fields of energy MIT had made studies this could produce enough power to exceed our need s into the next century . Partially due to other advances in energy consumption but working towards total elimination of debt through free energy for all to me that would mean $1,000 savings in month to month expenses a whole 5 bedroom house, and my soon two electric vehicles one truck and one passenger car. Also demanding all homes be converted to geo thermal energy from a 60 degree soil and water year round below frost line to help cool and warm us nearly free compared to now, by law conversion to high energy saving led lighting technology and promote American manufacturing in all these areas and steel and glass titanium production to keep valuable resources here 1st sold to American manufacturing 1stt with a resource renewal law that does not allow any secondary pollution from the production of anything here in the us
JennyCurlyLox October 02, 2013 at 01:59 PM
They are arguing about something that none of the members of Congress even want. Congress and their staff have to get their healthcare from the new marketplace, but it was too expensive for them and their staff. They automatically get subsidies that help their new Obamacare insurance be the same price as their old insurance, even though they are above the income threshold for subsidies. If it isn't good enough for Congress, then there shouldn't be any argument about keeping it or not. It's ridiculous!
Bobbyjack Smith October 02, 2013 at 02:37 PM
BISHOP,WHAT A SOB,HE ONLY WORKS FOR HIMSELF,NOT THE PEOPLE HE"S GREEDY SOB..
Bev Oliver October 02, 2013 at 03:08 PM
Here's what the Constitutional Amendment says (and notice that it was over 200 years between proposal and ratification): "AMENDMENT XXVII Originally proposed Sept. 25, 1789. Ratified May 7, 1992. No law, varying the compensation for the services of the Senators and Representatives, shall take effect, until an election of representatives shall have intervened." It DOES NOT REQUIRE THAT THE LEGISLATIVE BRANCH BE PAID, it ONLY REQUIRES THAT THERE IS A CHANCE THAT THE REPRESENTATIVES/SENATORS BE SUBJECTED TO RE-ELECTION IF THEY VOTE THEMSELVES AN INAPPROPRIATE RAISE! Just like our legislators don't read the bills they pass into law (and, yes, the Affordable Care Act is a law), they can't even interpret the Constitution and its Amendments!!! Remember this at election time, regardless of your political persuasion, vote!! Until our government sees that we are watching by getting our voting percentage above 30 something percent, we get the government we deserve.
Paul W October 02, 2013 at 04:58 PM
Dear congress, if I had my way, not only would you not be getting paid, I would charge each and everyone of you $1,000 per hour by adding the total to your taxes!
John Konopka October 02, 2013 at 06:18 PM
since the federal government has neither the power to hire/fire any member, nor control of the direction of outcome of their work, the congress is at best contractors, and at worst leaches.
