Shock Gets New Ice Cream Sculpture

As the national media continues to feature Shock's ice cream cone lawsuit, owner of Shock Elyse Richman has marked the occasion by buying a new 6-foot sculpture.

The sculpture, which she bought in Southampton, replaces the sculpture that is the center of a lawsuit and that Richman said was stolen.

The lawsuit started three years ago when Richman said she displayed the cone outside her shop for a children's birthday party. The Village cited her for not complying with its sign ordinance.

A lawsuit commenced and last year a village justice, J. Lee Snead tossed out Richman's violation. Richman thought the battle was over.

Then, the village board voted to appeal the decision, hiring attorney Herman Bishop at a rate of $190 per hour.

The village maintains that it must protect the village code and if it did not appeal, the village's ability to enforce its codes would be "severely impacted."
